The Weaponization of the Bar: How Free Speech Became Grounds for Disqualification

The Weaponization of the Bar: How Free Speech Became Grounds for Disqualification

By Maureen Steele

In a constitutional republic founded on the principles of free speech and due process, the idea that an individual could be denied the ability to practice law based on their political beliefs should be unthinkable. Yet, that is exactly what has happened to Samson Racioppi.

His story is one of service, resilience, and relentless advocacy for constitutional rights—yet it also reveals the creeping authoritarianism that has infected our institutions. A decorated Army veteran, Racioppi served as a Cavalry Scout in Operation Enduring Freedom, was honorably discharged as a sergeant, and later pursued his passion for law at New England Law | Boston. His record of advocacy, however, made him a target. From his involvement in free speech rallies to his role in organizing buses for January 6 attendees (without any allegation of wrongdoing), he has been subjected to relentless political persecution.

The New Hampshire Board of Bar Overseers (BBO) and the law school’s administration didn’t question his legal competency. Instead, they scrutinized his personal beliefs, participation in protests, and even statements taken out of context. A complaint, laden with ideological rhetoric rather than substantive concerns about his character or ability to practice law, accused him of creating a “fearful” environment simply by existing on campus. The mere fact that some students claimed to feel “unsafe” around a free speech advocate was enough to prompt institutional action against him.

This isn’t an isolated case; it’s a blueprint. Across the country, professional licensing boards, academic institutions, and bar associations are becoming ideological gatekeepers. What was once the noble profession of law—grounded in the principles of reason, debate, and advocacy—has increasingly become a mechanism to filter out those who refuse to conform to a rigid ideological orthodoxy.

But let’s be clear about what this really is: It is not about justice. It is about conformity. It is not about protecting people’s rights. It is about stripping them away. The Bar is wildly corrupt. It does not exist to uphold the Constitution—it exists to bypass it. It operates as the British Admiralty Regiment, an institution sworn to the Crown, not to the people. The very title “Esquire” is a title of nobility, something explicitly forbidden in our Charters of Freedom. Our legal system was supposed to be founded on common law, yet what we have today is a soulless, gutted system designed to serve the interests of the powerful while masquerading as a defender of rights.

The American judiciary is rotten to the core, and the Bar is its enforcement arm. I have written about this before, and this case is yet another glaring example. This is not reformable—it must be abolished. The legal system must return to what it was meant to be: a system where justice is rooted in the Constitution and the natural rights of the people, not in the whims of unelected bureaucrats and ideologically driven bar examiners.

Our nation is decaying from the inside out. It is time to clean house. It is time to restore justice by upholding our sworn oaths to the Constitution of the United States, the supreme law of the land. And it is time to rid our nation of any institution that places foreign allegiance above the rights of the American people. The Bar Association is one of those institutions, and its corruption is on full display. If we want justice in this country, we must first remove those who serve the Crown instead of the Republic.
